Sorry this is late guys! Busyness all around, and rewriting how Nightshade does what she does multiple times XD

Decent chances for the next couple weeks we may be doing 1 page a week instead of 2 while Seba tries to catch up on all the things he has to do. I’ll post more guest art and stuff to compensate :)

    Can you translate “Assumes facts not in evidence” from legal to normal English?

    • It’s a official courtroom jargon objection meaning that you’re making claims without showing evidence.

      huh, looking it up, looks like I used it slightly wrong. Hmm, might fix it.

        Black’s Law Dictionary …the layman’s friend.
        Tenzin can testify about his orders … that’s evidence … and if not (because of, I dunno, hearsay, though orders aren’t because of business records and such), he can still testify as to his motivation without actually proving up said orders.
        I suspect the defense would make arguments about classified evidence and perhaps some motions in limine or arguments made without much of a foundation (though this one seems solid) or not properly flagged in exhibit or witness lists, but that last is more about civil trials in our system … and there’s your out. This isn’t our system.

          I can see where this is going… but isn’t this a court-marshal? If this is not a court-martial cool, but if it is, the witnesses would all have the clearance needed to hear Tenzin’s testimony on events since only military officers would be permitted plus a military judge. Again, if it’s not a General Court-Martial as I understand it, cool. Just trying to wrap my brain around it.

          • It’s a weird court case. Court Martial would be Aegis only, as an internal matter, whereas this is being overseen by the Regency Council as a whole.

            Courts Martial, in my limited experience in the U.S. Navy, are not as-seen-on-TV a la LA Law & Ally McBeal. Evidentiary requirements & procedures are different, as is testimony. But I was a Corpsman and only very peripherally involved & aware. Somebody knowledgeable about these things explained it to me once, but that was over a quarter century ago – & she was my girlfriend… I may have had other things on my mind at the time. 🤔

            I hadn’t intended to imply any criticism, I was hoping that knowing that military courts operate differently then civilian courts might give you some leeway or inspiration

          So you’re thinking that theres is more of a Napoleonic code?

            I dunno, but more likely much more influenced than American courts are by some form of Roman law, where juries are weak, and often non-existent, and judges have a lot more of the prosecutorial role in their job description. The Haague or Edinborough seem to fit this better than an American-style jury trial in some respects, if not others.
            Louisiana’s Napoleonic code is still basically like other criminal courts in how it behaves. This court is also heavily Common-Law in that evidentiary fight are occurring in public and there’s a jury.
            Basically Danny-boy has free reign and justify his decisions post-facto.

      In modern U.S. courtroom (TV) dramas, the verbose phrasing would be something like “Objection: The answer calls for speculation by the witness.” Which is often shortened to “Objection. Speculation.” (Just in case you’ve been exposed to a bunch of Law and Order re-runs. :) )

          Given Tenzin’s experience in military operations, he could be asked to provide his “expert opinion” on standard ambush tactics - pointing out that what happened to the Keleres was consistent with well-known ambush techniques. This wouldn’t technically be speculation, since he’s comparing his version of events to established tactical doctrine, with that comparison supported by his expertise.

          Though I suspect you’ve already charted out this part of the story and we’ll see where it goes when it gets there. :)

          • Yeah, my problem is trying to shorthand the whole court scene, leaving to implication that most of these sorts of things happened without spending 50 pages on courtroom testimony XD

    I didn’t notice enough interaction between short-a-pin & sneakysneak for them to be coordinating him stalling to give her time to execute her mission . Did I miss something?

    The jurors will be all over the prosecution for suppressing that evidence. No need to skedaddle just yet … the verdict may well be worth sticking around for.
